Emerald Tours, Inc. terms and Conditions
Conditions & General Information: The conditions below form the basis of any contract between the customer and Emerald Tours, Inc. with its registered office at 3602 C Aspen Village Way, Santa Ana California 92704, herein after called Emerald Tours, an inbound tour company that specializes in sports, adventure and leisure vacations in the USA, including golf related tours, camps and tournaments.
When the customer contacts us to book a tour, the customer appoints Emerald Tours to act as their agent to obtain the requested services. When we have done so, and the customer has confirmed the booking and paid the deposit, we will accept responsibility for providing the vacation from that point onwards. No employee or representative of the Company has the authority to change these conditions or information. This Agreement shall be governed by the substantive laws of the State of California. Any disputes involving a Company tour will be fully resolved by the parties involved or if necessary, by arbitration as laid down by the Arbitrations laws of California Code, Title -9 ARBITRATION
Deposit & Final Payment: 50% percent at time of booking and balance due within 30 days of booking. Reservations made within 60 days of tour actually taking place require full payment at time of booking.
Cancellation: If customer cancels 30 or more days before the start of your tour, he/she is entitled to a full refund less any non refundable deposits we make on customer's behalf for transportation, accommodations, golf and other activities. No refunds are allowed 30 days or sooner before the start of your tour. However, the customer can apply his/her payment (less any non refundable deposits we make on customer's behalf) toward a future Emerald Tours package if used within six months after initial booking date. If the cost of the new tour is greater than the one cancelled, the customer will pay the difference between the amount originally paid to Emerald Tours and the price of the new tour less any non refundable deposits we pay on client's behalf. The Customer must avail himself/herself to this option within a period of six months after initial booking date. This option ceases to be effective if not availed within six months after cancellation.
Travel : Emerald Tours strongly recommends travelers have luggage, accident and trip cancellation insurance. It is important for your own self-interest and protection that you make certain you have adequate coverage. We suggest that you contact travel insurance providers in your home Country for quotes on coverage for your tour.
Car Rental: On those select independent tours with a rental car included (as stated in the detailed trip itinerary), all drivers must be over 25 years of age with a valid U.S. or international driver's license. If you international driver's license is not in English, they you will need to obtain an International Driving Permit in your home Country. International Driver's Permits are valid only if presented with your original local license. Travelers are also responsible for purchasing adequate insurance directly with the car rental agency at your own expense. Emerald Tours pays car rental and tax only. You are responsible for extra days, insurance and any other charges.
Air Travel: Travelers are responsible for all transportation costs from Country/City of origin to U.S. city where tour begins. Travelers are responsible for travel costs from U.S. city where tour ends back to home destination/Country. Unless otherwise stated, Emerald Tours only provides services after travelers arrive in the U.S. and clear U.S. Customs. Air travel within the U.S. is only included when the tour package (details contained in the company's website) specifically states that flights are included. No air travel is included in any of our tours unless specifically stated in our website promotional material.
Documentation: A current passport is required for travel to the U.S. A visa may also be required traveling from certain countries. Check the requirements in good time before departure. Citizens of other countries should check with the closest U.S. Embassy or Consulate. The Visa Waiver Program (VWP) allows citizens of participating countries to travel to the United States without a visa for stays of 90 days or less, when they meet all requirements. Travelers must be eligible to use the VWP and have a valid Electronic System for Travel Authorization (ESTA) approval prior to travel. For travelers requiring a U.S. Visa: You are responsible for applying for a U.S. visa at time of booking. Emerald Tours will provide you with an invitation letter upon request. In the event traveler is not granted a visa, cancellation policy stated above will apply to those customers showing written documentation confirming the denial.
Responsibility: Emerald Tours, as the tour operator, and its selling agents act only as agents in securing and booking the hotel accommodations and other land tour services provided as others as independent contractors. Emerald Tours, its selling agents or the specified air carriers assume and accept no liability for injury, loss, damage, accident. delay, changes or inconvenience caused by: any force majeure - health risks - reason of war or threat of war – riots - civil strife - terrorist activity - industrial disputes – acts, omission, neglect, delay or default of any person engaged in providing any tour services including transportation and accommodation - technical problems to transport - closure or congestion of airports or ports - building work - extended hotel closure - cancellations or changes of schedules by airlines - interruption or failure of public utilities outside the control of the hotel and similar events beyond our control, including storms, tempests and hurricanes.
If any tour service or its reasonable equivalent is not provided due to events beyond the reasonable control of Emerald Tours, the company will make an appropriate refund of that portion of the tour price covering the undelivered tour service (less non refundable deposits), but it is understood that we shall have no other or further responsibility or liability either for the accuracy of any representation or the non provision of any tour services.
Transport by aircraft, rail, ship or coach will depend on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation (available for inspection on request), and applicable provisions of law and treaty.
Emerald Tours is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.
Emerald Tours reserves the right to cancel a tour if circumstances so require. In the event of such, we will make a full refund to travelers of all payments received in respect of the tour. Such a refund of payments will be the full extent of our obligation and liability to travelers. This Agreement shall be governed by the substantive laws of the State of California. The parties irrevocably agree that any disputes will be totally resolved by arbitration in the State of California.
Brochure Accuracy: As far as is known all information in the promotional and other materials of Emerald Tours is accurate at the time of publication. Changes cannot be made after publication date, and the Company accepts no responsibility for any omissions or errors. Where they become aware of errors which could materially affect your travel package, they will take all reasonable steps to inform you in a timely manner.
Caddies for golf tours: Some golf tours include caddies at particular golf resorts, so it's important that you fully understand if caddies are included at any of the golf courses on your tour. Unless included in tour package, traveler is responsible for caddy costs if you request this service. Most U.S. golf courses do not offer caddies, but instead offer you golf carts fully equipped with GPS or mobile phone applications. Otherwise, as a free service to clients, we will request caddies for those who wish them at courses where this service is available, however they cannot be guaranteed and you are responsible for paying for caddy services unless included in tour package. If a caddie is secured for you, the caddie master or another club official will inform you of the caddie charge and tipping policy.
MEALS: Meals are only provided when specifically stated in each tour brochure.
TIPPING: Gratuities are not included in this tour and you are responsible for all tips in accordance with U.S. customs. It IS CUSTOMARY to tip service providers, including caddies, when they perform good service. The amount of each gratuity is at your discretion based on the quality of the service provided to you.
Credit Card Privacy Policy: We will safeguard the confidentiality and security of the information we obtain from you. This notice describes our privacy policy as it related to the collection, protection and disclosure of such information resulting from credit card transactions only.
Protecting Your Credit Card Information: The credit card information provided by you to Emerald Tours will be stored in a secure, confidential manner. This information will only be accessible to authorized personnel responsible for booking reservations and completing financial transactions. We maintain physical, electronic and procedural safeguards to protect your information.
Disclosure of Your Information: Emerald Tours does not disclose any nonpublic information (such as credit card numbers and their expiration dates) about our customers or former customers to anyone except as required by law or demanded by law or court order.
ACCEPTANCE: All travelers booking directly with us, outbound tour operators and other parties booking travel with Emerald Tours are required to sign as acceptance of these Terms and Conditions.
